The agreement between you and Anky. It covers what Anky does, what it does not do, what a listing costs, and who is responsible when a car changes hands.

The one thing to take away. Anky is a place to advertise a car and to talk to the
person selling it. Anky is not the seller and is not a party to your sale. The
contract is between the buyer and the seller. No money for a car passes through Anky, and nothing
here is a guarantee about a vehicle or about a person.
01These terms
Anky is run by [FULL LEGAL NAME], a sole trader trading as "Anky", of
[POSTAL ADDRESS]. In these terms "we", "us" and "Anky" mean that
person; "you" means you.
You accept these terms by ticking the box on the sign-up screen, which also confirms you are 18
or over. We record which version you accepted and when — this page carries its version as the
date at the top. Our Privacy Policy explains what we do with your
information and forms part of this agreement.
If we change these terms in a way that matters, we will tell you in the app before the change
takes effect.
Nothing in these terms takes away rights you have as a consumer under UK law that cannot be
signed away.
02Who can use Anky
You must be 18 or over.
Anky is for cars in the United Kingdom.
You may hold one account. Do not use somebody else's, and do not let anybody use yours.
You must not use Anky if we have previously closed your account.
03Your account
Keep your password to yourself and tell us at once if you think somebody else has got into your
account. Everything done through your account is treated as done by you.
The details you give us — your name, your location, your phone number if you publish one — must
be true and must be kept up to date.
04What Anky is, and is not
Anky is an advertising platform. It lets a seller publish a car and lets a buyer find it and get
in touch. That is the whole of the service.
Anky is not a party to your sale
When a car is sold, the contract is between the buyer and the seller and nobody else. We are not
the seller, not the buyer, not an agent for either, and not a broker. We hold no money for a
sale, we provide no escrow, and we do not deliver, inspect, transport or insure anything.
We do not check cars or people
We do not inspect vehicles, verify mileage, confirm that a seller owns what they are advertising,
run finance or theft checks, or verify anybody's identity. Listings are written by their sellers.
Estimated values, price ratings, running costs, monthly figures and match percentages shown in the
app are indicative only, generated from public data and from what a seller typed
— they are not valuations, not advice, and must not be relied on as either.
Meeting people
Buying a car means meeting a stranger and often carrying money. Meet somewhere public and in
daylight, take somebody with you, see the V5C logbook and check it matches the car and the
seller, and never pay before you have seen what you are buying. We cannot make any of that safe
for you.
05Selling a car
By listing a car you confirm that:
you own it, or you are entitled to sell it, and it is not subject to outstanding finance you have not disclosed;
everything you have said about it is accurate — the mileage, the history, the condition, the number of keepers, the reason it is being sold;
the photographs are of the actual car;
it is not stolen, not an insurance write-off you have failed to declare, and not subject to an outstanding recall you know about and have not mentioned;
you will take the listing down, or mark it sold, once it is no longer for sale.
Trade sellers must say so. If you are selling in the course of a business — even
a small one, even a few cars a year — the law requires you to make that clear to buyers, and the
Consumer Rights Act 2015 gives your buyer rights that a private buyer does not have. Advertising
a trade car as a private sale is a criminal offence under the Consumer Protection from Unfair
Trading Regulations 2008. If you sell more than a handful of cars a year, contact us about a
trade account rather than listing privately.
You keep ownership of your photographs and your words. By publishing them you give us a
non-exclusive, royalty-free licence to store them, resize them and display them within Anky, and
to show them in Anky's own promotion of the platform, for as long as the listing is up and for a
reasonable period afterwards.
06What it costs
Listing a car costs a flat £30, whatever the car is worth.
If the asking price is under £1,500, listing is free.
There is nothing further to pay — no commission, no renewal, no success fee. We take no cut of the sale.
The advert stays up until the car sells, or until you take it down.
Buying, browsing and messaging are free.
The fee is charged when you publish, and is taken through Stripe. We never see or
store your full card details. Prices include VAT where VAT applies; we will tell you the total
before you pay.
Cancelling, and refunds
As a consumer you normally have 14 days to cancel a service bought online. Because your advert
goes live immediately, by publishing it you ask us to start straight away and you accept that
you lose that right once the advert is live. If you take a listing down after it
has been published, the fee is not refundable.
If we remove your listing for breaking these terms, you are not entitled to a refund. If we remove
it in error, or the service fails so that your advert never ran, contact us and we will refund it.
We may change our prices. A change never affects a listing you have already paid for.
07Buying a car
A listing is an invitation to make contact, not an offer capable of acceptance. Making an offer
through Anky, or a seller accepting one, does not by itself create a binding contract of sale —
that is settled between the two of you when the car changes hands.
Do your own checks: view the car, take it for a drive, see the V5C and the service history, and
consider a professional inspection and a paid history check. Never send money to somebody you
have not met for a car you have not seen. Nobody at Anky will ever ask you to pay a deposit
through us, and any message telling you otherwise is a fraud — report it.
When a seller accepts an offer we may mark the car as reserved for a short period. That is a
courtesy so other buyers know where they stand; it does not oblige either of you to complete.
08What you may not post
Do not use Anky to publish or send anything that:
is abusive, hateful, threatening, harassing, or a slur against anybody;
is sexual, or involves anyone under 18;
is dishonest — a fake listing, a car you do not have, a price you will not honour, a bait advert for something else;
is a scam, a phishing attempt, or a request for payment outside the app for a car nobody has seen;
is somebody else's — their photographs, their words, their car, their identity;
discloses another person's private information;
advertises anything other than a vehicle for sale;
breaks any law, or infringes anybody's rights.
Anky screens listings and messages automatically for offensive language. That screen is not
perfect in either direction, which is why reporting exists.
Do not attempt to scrape the app, work around its rate limits, reverse-engineer it, probe its
security, or automate access to it.
09Reporting, blocking and removal
Every listing and every conversation carries a way to report it, and any conversation with a
private seller carries a way to block them. Blocking is immediate and is not announced: their
cars leave your deck, your conversation leaves both inboxes, and neither of you can start
another. You can undo it from your profile.
We read every report. We may remove a listing or a message, suspend or close an account, or
refuse service, where we reasonably believe these terms have been broken — and we will act
faster, and with less warning, where somebody's safety is involved. Where it is appropriate we
will tell you why and give you a way to respond.

10Number plates and MOT records
Anky can fill in a listing from a number plate using the DVSA's MOT History service, and shows
the MOT record it returns. That record is the DVSA's, not ours: we pass it on as it is given and
we cannot correct it, guarantee it is complete, or be responsible for what it says. A mileage
reading in an MOT record is what was entered at the test centre, and can be wrong.
Only look up a plate for a car you are selling or genuinely considering buying. Lookups are
limited per account and are logged.
11Ending it
You can stop using Anky whenever you like. Delete my account is on your profile
screen and it works immediately — you do not have to ask us, and nothing is held back.
⚠️ It takes more with it than your own account. Your listings are deleted, and
so is every conversation you are part of — which means those conversations leave the other
person's inbox too, because a conversation is one record shared between two people. This is
different from deleting a single conversation, where the other side keeps their copy. It cannot
be undone and we cannot get any of it back. The app tells you this before it does it.
We may close your account if you break these terms, if we are required to, or — on reasonable
notice — if we stop running Anky. Fees already paid for a listing that never ran will be refunded.
12Our responsibility to you
We will provide Anky with reasonable care and skill. If we fail to do that, we are responsible for
loss you suffer that is a foreseeable result of our breaking this contract or failing to use
reasonable care and skill.
We are not responsible for:
the condition, description, legality, safety or ownership of any car advertised on Anky;
anything a buyer or seller says or does, on Anky or off it;
a sale that falls through, a car that turns out to be other than described, or money lost in a transaction between users;
the accuracy of MOT records, estimated values, running costs or any other indicative figure;
loss that was not foreseeable when you started using Anky.
Where we are liable to you for something connected with a paid listing, our liability is limited
to the amount you paid us for that listing — except that this limit does not apply to the things
named immediately below.
Nothing in these terms limits or excludes our liability for death or personal
injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the
terms implied by the Consumer Rights Act 2015, or for anything else that cannot lawfully be
limited or excluded.
If you use Anky for business purposes, we are not liable to you for loss of profit, loss of
business, business interruption or loss of business opportunity.
13Changes and availability
We may change how Anky works, add features and remove them. We may take the service down for
maintenance, and it may be unavailable for reasons outside our control. We do not promise it will
always be available or free of faults.
We may change these terms. If a change matters to you we will tell you in the app before it takes
effect, and if you do not accept it you can close your account. The version on this page is the
one that applies.
14If you got Anky from the App Store
These terms are between you and us. Apple is not a party to them. In addition:
Apple has no obligation to provide any support or maintenance for Anky;
if Anky fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation at all in respect of Anky;
Apple is not responsible for addressing any claim by you or a third party about Anky, including product liability claims, any claim that Anky fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation;
if a third party claims Anky infringes their intellectual property, we — not Apple — are responsible for the investigation, defence, settlement and discharge of that claim;
you confirm you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties;
Apple and its subsidiaries are third-party beneficiaries of these terms and, on your acceptance of them, will have the right to enforce them against you.
Your use of Anky must also comply with the Apple Media Services Terms and Conditions.
15Complaints and the law that applies
If something has gone wrong, email help@ankycar.com first —
most things are quicker to fix that way than any other.
These terms are governed by the law of England and Wales, and the courts of England and Wales
have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in
your own country's courts, and you keep the protection of the mandatory consumer law of the place
you live.
If a court finds part of these terms unenforceable, the rest continues to apply. If we do not
insist on something straight away, that does not stop us insisting on it later.
